The Institutions of Private Law and Their Social Functions
Karl Renner, Otto Kahn-Freund, Agnes Schwarzschild
The book is concerned with the sociology of law, and, more particularly, with the impact of economic forces and social changes upon the functioning of legal institutions. The legal institutions which he examines are those which are classified as belonging to the sphere of “private law”: ownership in land and movable property, contracts of various types, mortgage and lease, marriage and succession. “Public law”, which includes the organisation of the state and of local government bodies is outside the purview of his analysis.
